EU Sustainability Regulations to Reshape German Business Certifications by 2026

Date:

On September 27, 2026, Germany will enforce new regulations on sustainability labels and certification schemes, mandating companies that use environmental, social, or employment-related seals to align with enhanced EU standards. This initiative is part of Germany’s Third Act Amending the Act Against Unfair Competition (UWG) and enacts the EU EmpCo Directive (2024/825). The reform is set to impose more rigorous criteria on sustainability labels and certain employer seals, which are often utilized in marketing and recruitment.

The updated framework will potentially limit the use of labels that are not anchored in recognized certification systems or established by public authorities. These regulations extend beyond environmental claims to possibly encompass social factors, including workplace conditions, employee satisfaction, fairness, and diversity, contingent on the nature of the seal being used. A credible certification scheme under these new rules must adhere to several key requirements: transparent documentation, criteria that are publicly accessible, equal access for participating organizations, and verification by an independent third party.

International companies that use employer or sustainability seals while targeting German customers, employees, or applicants could also be impacted by this regulation, even if they are based outside of Germany. Businesses using such certifications are encouraged to reassess their providers, documentation, and verification processes before the new rules take effect. The regulation shifts the emphasis from merely assessing whether a claim is misleading to evaluating whether the certification system supporting the claim is credible and independently verified.

Organizations with transparent certification processes are likely to gain increased trust, while those relying on unsupported marketing labels might encounter legal challenges. Industry experts advise companies to prepare by reviewing certification criteria, maintaining evidence of evaluation procedures, and ensuring all supporting documents are readily accessible. Additionally, seeking legal guidance on specific compliance issues related to competition law may be beneficial for businesses aiming to navigate these changes effectively.
